Pet Health Manager - Terms of Service

These Terms of Service ("Terms") govern your use of the Pet Health Manager mobile application ("the App"), published by Ruben Nahatakyan ("the Developer", "we", "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please uninstall the App and stop using it.

1. The App in plain language

Pet Health Manager is a personal organizer that helps you keep track of your pets' health information — medications, vaccines, weights, vet visits, and notes. It is designed for personal, non-commercial use by pet owners.

2. NOT MEDICAL ADVICE — IMPORTANT

The App is not a medical device, diagnostic tool, or substitute for professional veterinary care.

The App does not:

  • Diagnose, treat, cure, or prevent any disease
  • Provide veterinary advice
  • Validate dosages or detect drug interactions
  • Replace consultation with a licensed veterinarian
  • Guarantee that reminders will be delivered (delivery depends on your device, iOS, and notification permissions)

Always consult a licensed veterinarian for medical decisions about your pet. Vaccine due-date predictions shown in the App are heuristic estimates for organizational convenience only and must be confirmed with your veterinarian. The Developer is not liable for any harm to a pet, person, or property arising from reliance on information stored in or generated by the App.

If your pet is in distress, contact your veterinarian or an emergency animal hospital immediately. Do not use the App as a substitute for emergency care.

3. License to use the App

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, subject to the rules of the Apple App Store and these Terms.

You may not:

  • Reverse-engineer, decompile, or disassemble the App
  • Modify, adapt, or create derivative works of the App
  • Remove, alter, or obscure any copyright, trademark, or other notice
  • Use the App in connection with any unlawful purpose
  • Use automated means to scrape, mirror, or harvest data from the App
  • Sublicense, resell, rent, lease, or distribute the App

4. Subscriptions (Pet Health Pro)

The App is free to download. Some features require a paid subscription called Pet Health Pro, which is offered as an auto-renewable subscription through the Apple App Store.

What Pro unlocks

  • Unlimited pet profiles (free tier is limited to 1 pet)
  • iCloud sync across your Apple devices
  • PDF export of pet health summaries

Pricing and billing

Subscription pricing is shown in the App at the time of purchase, in your local currency. As of this version:

  • Monthly: $0.99 USD per month
  • Yearly: $9.99 USD per year, with a 7-day free trial for first-time subscribers

Prices may vary by region and are subject to change. You will see the exact price before any charge.

Auto-renewal

Subscriptions automatically renew for the same period unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription at any time in your Apple ID account settings:

Settings → [Your Name] → Subscriptions → Pet Health Pro

Cancellation takes effect at the end of the current paid period; you will not be refunded for the unused portion.

Free trial

The 7-day free trial on the yearly plan is available only to first-time subscribers. If you do not cancel before the trial ends, your Apple ID will be charged the yearly subscription price. You can cancel anytime during the trial in your subscription settings without being charged.

Refunds

Refunds for subscriptions are handled by Apple, not the Developer. To request a refund, visit https://reportaproblem.apple.com/

5. Your data

You retain full ownership of all data you create in the App. The Developer has no access to your data; see the Privacy Policy for details on storage and security.

You are responsible for keeping your own backups. Although iCloud sync (Pro feature) provides redundancy across your devices, it is not a backup service. We strongly recommend periodically using the Export to PDF feature to keep an offline copy of important records.

If you uninstall the App without first exporting your data, all locally stored data will be permanently deleted. iCloud-synced data will remain in your iCloud account until you delete it manually.

6. Acceptable use

You agree to use the App lawfully and only for tracking your own pets' health information. You will not use the App in any way that:

  • Violates any applicable law or regulation
  • Infringes on the rights of any third party
  • Interferes with the App's normal operation
  • Attempts to gain unauthorized access to other users' data (note: there is no shared data, but the rule still applies)

We reserve the right to terminate your license if you breach these Terms.

7. Intellectual property

The App, including its source code, design, branding, and content created by the Developer, is the property of the Developer and is protected by copyright, trademark, and other intellectual property laws. The names "Pet Health Manager" and "Pet Health Pro" are trademarks of the Developer.

Apple, iCloud, CloudKit, App Store, iPhone, iPad, and Apple Watch are trademarks of Apple Inc., used here for descriptive purposes only.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION.

WE DO NOT WARRANT THAT:

  • THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS
  • ANY REMINDERS OR NOTIFICATIONS WILL BE DELIVERED ON TIME OR AT ALL
  • DATA STORED LOCALLY OR IN ICLOUD WILL NEVER BE LOST OR CORRUPTED
  • VACCINE DUE-DATE PREDICTIONS WILL MATCH YOUR VETERINARIAN'S RECOMMENDATIONS

You use the App at your own risk.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID THE DEVELOPER VIA APPLE FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) ZERO IF YOU HAVE NEVER PAID FOR A SUBSCRIPTION.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you. Where prohibited, our liability is limited to the smallest amount permitted by law.

10. Indemnification

You agree to indemnify and hold the Developer harmless from any claim, demand, loss, or damages arising out of your breach of these Terms, your misuse of the App, or your violation of any rights of a third party.

11. Changes to the Terms

We may update these Terms from time to time. The "Last updated" date above will reflect the most recent version. Material changes will be announced inside the App. Continued use of the App after a change constitutes acceptance of the new Terms.

12. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you violate these Terms. Termination does not entitle you to a refund of any unused portion of a paid subscription; subscription refunds are handled by Apple.

13. Governing law

These Terms are governed by the laws of Armenia, without regard to its conflict-of-law principles. Any dispute will be resolved in the courts of that jurisdiction. If you live in the European Union, your statutory consumer rights remain unaffected.

14. Apple End User License Agreement

You acknowledge that these Terms are between you and the Developer, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App. In the event of any failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any).

If any term of these Terms conflicts with the Apple EULA, the Apple EULA takes precedence to the extent of the conflict.
